Compliance and Legislation

Support to Meet NSW Strata Requirements

Strata compliance can feel complex. We help owners and committees understand their responsibilities under NSW strata, community title, WHS and planning laws, as well as local council requirements, including fire safety, essential services and required reporting.

We coordinate fire inspections, annual fire safety statements (AFSS) and essential service checks in line with the Environmental Planning and Assessment legislation and current fire safety regulations. This work is carried out based on reports from accredited practitioners, with responsibility remaining with the Owners Corporation.

We work with reliable contractors and accredited practitioners so that buildings remain safe and compliant as AFSS requirements and standards evolve.

We help committees understand their by-laws, apply them fairly, and update them when needed. We also keep you informed about changes to NSW strata, community land and tenancy legislation that affect your scheme.

Local Council Requirements

Macarthur and the surrounding regions are subject to flood, heritage, and bushfire overlays that impact approvals, usage, and maintenance obligations. We keep you informed about these conditions so that committees can make confident, well-informed decisions.

We also stay informed about changes made by amending laws, such as the Strata Schemes Legislation Amendment Act 2025, which is progressively changing strata and community land obligations.

FAQs

These answers cover strata schemes, community associations, neighbourhood associations and building management committees. Different rules apply depending on the type of scheme and its governing legislation.

What is a strata scheme?

A strata scheme is a form of property ownership where you own your individual lot and share ownership of common property such as roofs, driveways, stairwells and gardens with other owners.

What do I actually own?

In most cases, you own everything inside your lot. This depends on the registered strata plan and its date, particularly for schemes registered before July 1974.

Items such as walls, ceilings, structural elements, pipes, roofs and external features are usually common property. However, the registered strata plan always determines who is responsible.

What is the Owners Corporation?

The Owners Corporation is the legal body made up of all lot owners in the scheme. It is responsible for managing common property, finances, insurance, compliance and by-laws.

What does the strata committee do?

The strata committee makes day-to-day decisions on behalf of the Owners Corporation between general meetings, within the limits set by legislation and resolutions.

What does a strata manager do?

A strata manager assists the Owners Corporation by organising meetings, managing finances, coordinating repairs, arranging insurance and ensuring compliance with NSW strata legislation.

What are strata levies, and what do they pay for?

Levies fund building insurance, cleaning, gardening, maintenance, repairs, compliance costs and long-term upkeep of the property.
